These Terms of Service ("Terms") govern your access to and use of the PhantomNote website (https://phantomnote.co), account registration, license purchase, and the PhantomNote macOS application (collectively, the "Service") provided by PhantomNote ("we", "us", or "our").
By creating an account, purchasing a license, downloading the app, or using the Service, you agree to these Terms and our Privacy Policy, Refund Policy, and End User License Agreement (EULA).
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. You are responsible for ensuring your use complies with local laws.
2. The Service
PhantomNote is a macOS teleprompter and floating notes application for creators, presenters, and professionals. Features may include ghost mode (attempting to hide the overlay from screen capture), keyboard shortcuts, and local note storage. Features may change over time; we do not guarantee compatibility with every screen-sharing or recording tool.
3. Accounts
You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. Notify us immediately at support@phantomnote.co if you suspect unauthorized access.
4. License purchase
PhantomNote Pro is sold as a one-time license currently priced at $25 USD (plus applicable taxes). Payment is processed by Creem. Upon successful payment and license activation, you receive a personal, non-exclusive license to use the macOS application subject to these Terms and the EULA.
Unless stated otherwise, one license is intended for use by a single individual. You may not share, resell, or sublicense your account or license key.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or fraudulent purposes
- Reverse engineer, decompile, or attempt to extract source code except where permitted by law
- Circumvent license verification, payment, or security measures
- Interfere with or disrupt the Service or other users
- Use the Service in a way that infringes third-party intellectual property or privacy rights
6. Intellectual property
The Service, including software, design, branding, and documentation, is owned by PhantomNote or its licensors. Your license does not transfer ownership. You retain ownership of content you create in the app (e.g., your notes).
7. Third-party services
The Service integrates with third parties including payment processors (Creem), hosting providers, and macOS system APIs. Your use of third-party services may be subject to their terms and policies.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT GHOST MODE OR CAPTURE EXCLUSION WILL WORK WITH ALL SCREEN-SHARING, RECORDING, OR CONFERENCING APPLICATIONS ON ALL macOS VERSIONS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHANTOMNOTE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR $25 USD, WHICHEVER IS GREATER.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, for fraud prevention, or where required by law. Upon termination, your right to use the Service ends; sections that by nature should survive will survive (e.g., disclaimers, liability limits, governing law).
11. Changes
We may modify these Terms. We will post updates on this page with a revised date. Continued use after changes constitutes acceptance. Material changes may be communicated by email.
12. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in India shall have exclusive jurisdiction, unless mandatory consumer protection laws in your country require otherwise.
